Privacy policy

1. Object

1.1. The purpose of this Privacy Policy is to inform Users about the nature of the personal data collected and processed by Alogo, as well as the purpose of this processing and Users' rights regarding the personal data collected.

1.2. This Policy applies in addition to the general conditions and other documents included in the Contract Documentation. In the event of any discrepancy between the general conditions and the present conditions, the latter prevail.

1.3. In case of disagreement with this Policy, the User is invited not to use the Web Site, the App or the Platform and not to communicate his personal data.

1.4. Translation. In the event of any discrepancy between the English and the French version of this present Policy, the French version prevails.

2. Collected data

2.1. Information collected automatically. By navigating to the Web Site or using the App, certain data concerning the User are collected automatically (IP address, location, pages of the Platform visited, date and time of consultation, cookies, browser preference, operating system, access data, etc.). 2.2. Information provided freely by users. The User may be required to provide personal data concerning him in order to benefit from the Services offered by Alogo. Some data is transmitted automatically thanks to Alogo Move when it is placed on a horse (GPS coordinates for example). The necessary data for the use include the email address, first name, last name, location, delivery address, billing address, password, name of his horse, the height of the sensor and some information related to the results. These data are mandatory and their absence may make the provision of the Services impossible. Beyond the necessary data to access the Services, optional data may be provided voluntarily by the User (photography, sex, additional information on the rider and the horse, etc.). The data necessary for the use (mandatory) are mentioned in the forms by adding an asterisk or the impossibility to validate the form without filling the dedicated field. The data transmitted automatically by the sensor are mandatory.

2.3. Information provided by third parties. Alogo reserves the right to allow Users to register on the Platform via a social network login or to link their user account to such service providers (eg Google), if necessary, the User gives permission to Alogo access, collect and use information related to the social profile (name, surname, e-mail address, etc.). In addition, in order to improve the content of the offers proposed by Alogo based on the personal interests of the User, Alogo reserves the right to allow the User to share with Alogo data collected by third parties such as Facebook, Google, or any other internet service provider that could be linked to its user account from the dedicated Platform page. In addition, certain information is transmitted to Alogo during horse shows in which the User participates.

2.4. Information concerning minors. No data concerning minors under the age of 13 years old is collected. Data that could be collected unintentionally is destroyed as soon as possible. Personal data of minors between 13 and 16 years can be collected with the consent of parents or legal representatives.

3. Use of collected data

3.1. Data collected automatically. The data collected automatically allows Alogo to analyze the behavior of Users on the Web Site, traffic and preferences, in particular to optimize and improve the quality of its Services.

3.2. Data provided by Users or third parties. Alogo processes and uses the data necessary to fulfill its contractual obligations, to allow the display of the results desired by the User when using the Services offered by Alogo and to verify compliance with the conditions of use. The processing of this data also allows providing personalized content to better meet the expectations of the user.

4. Communication and data transmission

4.1. The personal data of the User are not transmitted to third parties with the intention of using them for direct marketing purposes, unless otherwise authorized by the User.

4.2. The personal data of the User may be transmitted or communicated to third parties in the following cases: (i) for the purpose of executing the contract binding the Buyer and Alogo (for example for delivery). The data collected as part of the Alogo MOVE Pre-Orders may also be used for the purpose of promoting similar or identical items that may be of interest to the User; (ii) in the provision of services on behalf of Alogo; (iii) where the User has consented thereto; (iv) during promotions or joint programs with partners (horse shows for example); (v) where required by law or communication is reasonably necessary to enforce a judicial decision or to respond to a legal claim; (vi) in the case of a merger, acquisition of the company or business shares by another company.

4.3. Alogo reserves the right to anonymize certain data for the purpose of transmitting it to third parties for research, statistics or marketing purposes.

5. User rights

5.1. Access right. The User may at any time request access to his personal data stored by Alogo.

5.2. Right of rectification. The User whose data is inaccurate or incomplete has the right to obtain their correction.

5.3. Right of withdrawal and / or opposition. The User may at any time oppose the collection or processing of certain data concerning him (opting out). This opposition may result in the termination of use of the Web Site, the App or the Platform.

5.4. Right to cancellation. The User has the right to request the suppression of personal data concerning him when their use is no longer necessary or the User no longer agrees with the processing of his data. These data will be deleted as soon as possible, unless otherwise provided by law.

6. Security

6.1. Alogo takes the data protection of its Users very seriously and undertakes to treat their personal data confidentially and with the utmost care. In particular, Alogo takes appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of the data collected pursuant to art. 7 on the Federal Data Protection Act (DPA - LPD) and 8 to 9 of the Ordinance on the Federal Data Protection Act (OLPD). However, although some personal data is encrypted, Alogo cannot guarantee full and complete protection of the data against unauthorized processing due to the risks associated with the use of the internet and electronic communication means.

7. Data retention

7.1. The data collected by Alogo is retained for as long as the purpose for which it was collected requires it, subject to legal provisions providing for longer data retention periods. After this time, personal data will be deleted.

8. Changes

8.1. Alogo reserves the right to modify its Privacy Policy at any time. The modifications will be published on the Web Site and will come into effect from the date of posting.

8.2. The Online Privacy Policy is applicable. By continuing to browse the Site or the App, the User accepts the privacy policy in force.
